Rules & Regulations

Your membership will commence on the Start Date, from which date you will be entitled to access the facilities of Motion Fitness in accordance with your selected membership type and will continue for a fixed period payable upfront or via debit order. Should you wish to terminate your membership on the termination date of your initial period, then you should notify your home facility by giving one (1) calendar month’s prior written notice. Please keep in mind that Motion Fitness may at any time withdraw all or part of its facilities for any period in connection with the repair, alteration or refurbishment of the facilities or for any reason beyond the control of Motion Fitness.

Please take note of the below fee structure and understand that all of the below fees are applicable for each and every membership.

  • Entrance Fee: This is an activation fee and is applicable to each and every new membership.
  • Card Fee: Each member is required to pay a card fee for their access card. Lost or stolen cards are charged as per the current price list.
  • Pro-Rata: A Pro rata fee is payable upon joining for the remainder of the current month.
  • Monthly Debit Order Fees and Upfront monthly fees: These fees are in accordance with your membership type and as per the price list of Motion Fitness. The monthly fee is applicable for all members and is payable to ensure the continued availability of services in accordance with your membership agreement. These fees are used for running costs, consumables, water, lights, rent, etc.
  • Annual Special Levy (13th fee): The annual special levy is applicable to all memberships and it will be debited along with your normal monthly fees in December each year. This fee is used to upgrade the facility. This fee is calculated and charged at your current monthly rate. Take note that the fees structure may change from time to time at the discretion of the Directors of Motion Fitness
  • All members must fill in a Physical Activity Readiness Questionnaire (PARQ) before using the Club facilities for the first time. If you are found to be moderate risk or high risk we will ask you to give us a medical clearance certificate before we allow you access.
  • It is recommended that you please check with your healthcare provider before you start a new fitness programme. You should have a physical exam to see if you have any health risk.
  • Please ensure to warm up before you exercise and cool down after your workout. You stand the risk of damaging your muscles and straining your heart.
  • If you experience acute pain, dizziness, sudden headache or chest pain, stop exercising immediately and inform a staff member.
  • Please let us know if there is any change in your medical condition.

GENERAL CLUB RULES

Our operating hours are displayed at the entrance and may vary from Club to Club. Please ensure you leave the Club punctually at closing time. The Club will be closed on the following days: Christmas Day and New Year’s Day.

The Directors of Motion Fitness reserve the right to close the facilities (and/or parts of the facility) and/or amend the operating hours of the facility at any time for reasons including but not limited to: repair, refurbishment, upgrade and building. Certain closures or unavailability of facilities, equipment and/or  classes are necessary and will occur from time to time, and therefore you will have no claim against the company whatsoever in respect of unavailable or closed facilities, equipment and/or classes that would usually be available

  • Pets (other than guide dogs) are not permitted.
  • Firearms or other weapons are not permitted.
  • Smoking is not permitted anywhere on Club premises.
  • You may not take any photographs or videos.
  • You may not bring alcohol or drugs into the Club.
  • You may not sell and/or market any product or service to any member while in our Club.
  • You consent to us using your image if taken during a photo shoot.
  • The use of Motion Fitness logo for promotional, marketing or advertising means is prohibited.
  • Time restrictions apply to off peak memberships. Please refer to Club times for details.
  • Please contact your home Club if you would like further details of the different membership types.
  • We reserve absolute discretion when approving membership applications.
  • Complaints should be made to the Club General Manager or through the Welcome Desk.

ACCESS POLICY

  • An Access Card will be issued to you when you join.
  • All members must have their photograph taken for their access card.
  • All members are required to produce their access card when accessing the facility.
  • Please report a lost or stolen card to your home Club. You will be issued with a replacement card at the current card fee rate.
  • Should you come to the Club without your access card you will be asked for a photo ID. We will only allow access to the facility with an ID two consecutive times, after which a new access card will be issued at the current card fee rate.
  • Access Cards are not to be used by any person other than the member, if you allow your access card to be used by another person, your membership may be terminated and you will forfeit any initial fees already paid.
  • Access to the facility may be denied to the card holder and dependents if the membership is in arrears, or if we terminated, resigned, suspended, pended, frozen or if the member has breached any of the terms and conditions of this agreement.

LITTLE MOVERS

  • Any Child under the age of 12 years must use the Little Movers centre whilst in the Motion Fitness facility.
  • Little Movers Membership is only available to the direct children (sons and/or daughters) of a Premier or Off-Peak Motion Fitness member.
  • Children under the age of 12 years old must be signed into the Little Movers centre unless involved in third party squad or personal training/coaching.
  • Children under the age of 12 years old may not be present on the training floor under any circumstances.
  • Children may only use the supervised child care facility for a maximum of 2 hours per day. A Parent/legal guardian must sign their children into Little Movers and must present their access cards. Only the same parent is allowed to sign out the child from the supervised area.
  • Little Movers operating hours at each Club and may vary.
  • Parent(s)/legal guardians may be asked to remove their child from Little Movers if, in the opinion of our staff, the child is upset, ill or disruptive.
  • Parents may not stay in Little Movers longer than 5 minutes. A maximum of 10 minutes is permitted should they be settling a baby or child. Parents are not permitted to sit and watch TV or supervise any of the activities in this facility.

JUNIOR MEMBER AGE RESTRICTION

  • All juniors 4 years and older are not permitted to accompany their parent/guardian into the change room of the opposite gender.

Between 12 and 14 years of age (13 years, 11 months and 30 days):

  • Children between the ages of 12 and 14 years enjoy the full benefits and rights associated with their Membership but must be supervised by a parent at all times whilst on the training floor (whether making use of equipment or not) and always give preference to Adult Premier Members during peak times.
  • The Premier Membership allows access to all facilities and group training classes given at the Club with the exception of:
    • Third party facilities or services hosted by Motion Fitness, e.g. Sun-bed, personal training, etc.
    • Any group training class where any additional attendance fee is advertised.
    • Any squad training or high performance training given by Motion Fitness or third party trainers at the Club.
    • Any products or services offered by the tenants of Motion Fitness.
    • May not use the steam room or sauna.
    • The Premier Membership allows access to the facility for the duration of the facility’s advertised operating hours.

Between 14 and 18 years of age (17 years, 11 months and 30 days):

  • Children between the ages of 14 and 18 years enjoy the full benefits and rights associated with Premier Membership but must give preference to Adult Premier Members during peak times.
  • The Premier Membership allows access to all facilities and group training classes given at the Club with the exception of:
    • Third party facilities or services hosted by Motion Fitness, e.g. Sun-bed, personal training, etc.
    • Any group training class where any additional attendance fee is advertised.
    • Any squad training or high performance training given by Motion Fitness or third party trainers the Club.
    • Any products or services offered by the tenants of Motion Fitness.
    • The Premier Membership allows access to the facility for the duration of the facility’s advertised operating hours.

18years +

  • Will not have access on the family membership and will need to re-join on a student rate or take out their own membership.

Student Rates

  • You will only qualify as a student on presentation of a valid student ID, and be limited by being a full time student up to the age of 25 years old.

GUEST

  • At our discretion, you may bring guests to train with you on payment of the guest fee or redemption of promotional voucher.
  • All guests or non-members are required to complete the Guest Register each and every time that they access and/or use the facility.
  • Guests fees may be amended at any time at the discretion of the Directors of Motion Fitness.
  • All guests/non-members entering and utilizing our facilities must at all times abide by the rules of the facilities and failure to do so may result in the guest or non-member being asked to leave the facilities or in extreme cases banned from the facilities.
  • Motion Fitness reserves the Right of Admission to all of its facilities.

BEHAVIOR, DRESS CODE & PERSONAL HYGIENE AND BEHAVIOUR

  • You may not enter the Club or use the facilities whilst under the influence of alcohol, illegal and/or performance-enhancing drugs or supplements (including steroids).
  • You may not use or sell any form of illegal and/ or performance-enhancing drugs (including steroids) on club premises or in the parking area.
  • Any allegations, suspicions and/or evidence of infringement of this rule gives us the right cancel or suspend your membership at our absolute discretion.
  • You must not use foul, loud, offensive or abusive langue (including, without limitation, discriminatory language based on an individual’s race, ethnic or social origin, colour, gender, sexual orientation, age, religion or disability.)
  • You must not commit any acts of intimidation or threats, or use menacing behaviour towards other members, guest, visitors, tenants or members of staff.
  • You must not physically or sexually abuse or harass, or use violent conduct towards other members, guest, visitors, tenants or members of staff.
  • You must not commit any unhygienic immoral act or acts which may cause distaste, revulsion or abhorrence to any other member or member of staff.
  • You have to pay for a damage caused by you, your dependents and your guests while in the Club.
  • Only one individual in a shower cubicle at any one time please (unless it’s your own child under the age of 4).
  • All persons entering the facility and using the facility must be dressed in appropriate gym attire, cross trainers must be worn while exercising (no slops, except in wet areas), no bare chests are allowed, please wear a T shirt or a vest.
  • Non-marking shoes to be worn in the studios and squash courts.
  • Please use a gym towel during your exercise routine and wipe down all equipment after you have used it.
  • No Food items, drinks (other than drinks in closed plastic bottles) or bags allowed on the training/circuit floor.
  • Please only use equipment for the intended purpose and in the correct manner, staff members will be on hand to help at your request.
  • Please use the circuit machines in numerical order and adhere to the time limits specified by the timer and/or the individual machine.
  • Please replace all equipment and weights after you have finished with them.

PARKING

  • Parking is only for guests while using Club facilities.
  • Please park in designated parking bays. If your car is not parked properly, it may be clamped and a fee charged for its release.
  • Please do not leave valuables visible inside your vehicle and store your keys in a locked locker.
  • All vehicles are parked and driven at own risk. We do not accept responsibility for any loss, theft and/or damage to vehicles and/or valuables left in vehicles or any other mode of transport of members or their guests whilst on Club premises or in any parking area designated for use by members or their guests.

LOCKER & PERSONAL BELONGINGS

  • Subject to availability, lockers are provided in the changing rooms to store your gear while you train. (Please bring your own padlock and lock your locker).
  • We do not undertake that the use of a locker will guarantee that theft of or damage to your property will not occur. Please check that your personal insurance policy covers you for loss or theft of money or loss or damage to personal property of members or their guests whether locked in a locker or otherwise.
  • Do not leave your belongings unattended in the change rooms or anywhere else in the Club at any time and report any lost item immediately to a staff member.
  • Lockers may only be used for keeping gym kits, toiletries and clothing that you were wearing when you came to the Club. If we have reasonable grounds for thinking that a locker is being used for the storage of something else, we may open the locker and remove any offending items.
  • Lockers are available for use only while you’re in the Club. Any belongings left in a locker overnight, will be removed and donated to charity if they are not collected within 14 days.
  • Any belongings so removed or left unattended will be available at lost property at your Club for 14 days. If you do not collect it within this time, we will donate it to charity.

USE OF EQUIPMENT & FLOOR

  • Please use the equipment for its intended purpose and follow the instructions provided. Do ask for help if you need it.
  • Please inspect equipment before use and do not use the equipment if it appears damaged and/or inoperable or any component appears to be missing, worn and/or damaged.
  • Please report damaged equipment to a staff member.
  • When using strength equipment make sure that the weight pin is completely inserted. Never pin the weight stack in an elevated position. Inspect all cables, straps and other connections.
  • Please do not use dumbbells or any other equipment, other than equipment specifically provided by the manufacturer; to incrementally increase weight resistance on strength equipment.
  • Ensure that the belt has come to a complete stop before stepping onto or getting off a treadmill.
  • Handle weights and equipment with care and replace after use.
  • While completing a circuit, move with the timer and use the equipment in numerical order.
  • Please observe the time limits if specified on the equipment.
  • No food drinks or bags are allowed on the training floor, with the exception of plastic water bottles and sports drinks.
  • Please use a sweat towel at all times and wipe equipment after use.

USE OF STUDIOS

  • Some classes may need to be pre-booked or may have maximum head-counts. Class timetables and instructors may change from time to time without notice
  • Please arrive a few minutes early for a class as you may not be allowed to join if you are more than 5 minutes late.
  • Timetables and schedules of classes are available at Welcome Desk
  • It is at the discretion of the instructor to let you partake in a class or not.
  • Once a class is in progress, no members are allowed to enter a class.
  • Times and duration are subject to change at any time, please consult the notice board and/or Welcome Desk for any changes to the timetable.

VIBRATION PLATES

  • Please read and observe the guidelines displayed near the vibration plate equipment and consult a doctor if you are concerned about your health risk prior to using the equipment.
  • Children under the age of 16 years may not use the vibration plates.

INDOOR CYCLING

  • Only one cycle may be booked per member where available.
  • First come, first serve basis.
  • Please arrive a few minutes early for a class as you may not be allowed to join in if you are more than 5 minutes late.
  • Please ensure that you have warmed up.
  • It is at the discretion of the instructor to let you partake in a class or not.
  • Once a class is in progress, no members are allowed to enter a class.

SQUASH COURTS

  • Court bookings are for 30 minute sessions only.
  • One session per game is allowed to be booked at peak times.
  • Bookings are recorded on the booking sheet at Welcome Desk. Bookings can only be made a maximum of 24 hours in advance.
  • R50 deposit will be payable when booking squash for the first time. This R50 booking fee is refundable (on proof of receipt), should you decide not to play anymore the R50 will be forfeited should you not arrive for your squash booking.
  • If you need to cancel, please tell the club no less that one hour prior to your booking.
  • If you do not arrive within 10 minutes of your booked court time, then the court might be allocated to other members.
  • Appropriate squash shoes with non-marking soles must be worn on the courts.

PERSONAL TRAINING

  • Should you be interested in getting a Personal Trainer, information regarding fees and bookings is available at the Welcome Desk. Only authorised Motion Fitness Personal Trainers are permitted to provide personal training in our Clubs. Personal Training by another member is not allowed whether it’s for payment or not. If we find someone providing unauthorised Personal Training our Club Manager will investigate, and you and the trainer may be expelled or suspended.

SWIMMING POOL

  • No lifeguard supervision is provided at Motion Fitness.
  • Children under the age of 14 years must be supervised by an adult at all times.
  • The pool area may be slippery when wet, so please be careful when entering.
  • Please shower before entering the pool, wear a swimming cap and costume and observe any swimming direction displayed in the pool area.
  • When sharing a lane please swim in an anti-clockwise direction.
  • Please do not jump or dive into the swimming pool or run around it.
  • You may not use the pool if you have a communicable disease.
  • Please do not use balls, floats or inflatables other than those provided by the Club.
  • Babies and Toddlers must wear aqua nappies or specifically designed baby swim trunks.
  • Swimming pool lanes may be reserved for swim schools, please check the notice board or at reception for details and class times.

SAUNA AND STEAM ROOM

  • Children under the age of 18 years may not use the sauna or steam room.
  • If you are elderly or pregnant or suffer from heart disease, diabetes, high or low blood pressure or any other serious medical condition you are advised not to use the sauna or steam room.

Please:

  • Shower before entering the sauna or steam room.
  • Sit on a towel when using the sauna or steam room.
  • Observe a reasonable time limit. Ten minutes or until perspiration begins is recommended – after which you should shower and cool down, and if you wish to return for another brief stay.
  • Never use oils, creams or cosmetic products in the sauna or steam room.
  • Never shave or exfoliate.
  • Never dry clothing or towels in the sauna.
  • Always wear a costume or cover your body with a towel when using the sauna or steam room.
  • Do not touch the sauna hot rock unit.

SAFETY

  • Please do not tamper with fire doors or any safety devises.
  • Please follow the health and safety notices displayed throughout the Club.
  • Please take note of emergency procedures. If there is an emergency please follow the staff’s instructions at all times.
  • Please do not run in the Club. Be aware of the different floor surfaces that you move across as you walk through the Club. As ongoing cleaning and maintenance will be taking place, related tools and equipment may be hazardous, and some floor surfaces may be wet and therefore slippery. Proceed with caution in these areas.
  • Please report all injuries/incident and/or any hazards to a staff member.
  • All members are requested to let common sense prevail when entering and using the facilities and behave in a manner which will not affect the safety and/or security of other members, guests, visitors, tenants and staff members.

FREEZING POLICY

  • Freezing requests will only be authorized for the following reasons:
    • Ill health – A Doctor’s note supporting this information must be handed in on completion of your Freezing Form
    • Pregnancy – A Doctor’s note supporting this information must be handed in on completion of your Freezing Form
    • Overseas / Extended Business Trips – Sufficient proof of this trip must be supplied in advance (i.e. Flight tickets / proof of accommodation etc.)
    • Religious reasons – Subject to approval
  • All above reasons can only be authorized and processed once supporting documentation received. Failure to do so will result in the freezing not being processed.
  • A request to Freeze a membership must be done in writing by completing a Freezing Request Form and receiving a Proof of Receipt Document, and handing in the relevant supporting documentation on request. The POR Document must be given to the customer as reference. This must be done at the Range / Club Welcome desk.
  • Memberships may be frozen for a minimum of 2 month and a maximum of 6 months.
  • Freezing period will always be a full calendar month. This will be from the 1st day of the month to the last day of the month
  • Memberships paying a monthly membership fee will be charged a monthly freezing fee via D/O, which will be calculated at a third of their Monthly D/O fee.
  • Upfront memberships will be charged a monthly freezing fee that must be settled upfront, which will be calculated at a third of the Monthly value, and multiplied by the amount of months they would like to freeze.
  • Upfront and D/O members initial periods (12month / 24months agreements) will be extended by the requested freezing period, as the Freezing period cannot be calculated at usage of your initial membership period.
  • Only memberships that are on an active status can be frozen.
  • Only memberships with no outstanding arrears can be frozen.
  • Short term memberships [1, 2 and 3 month memberships] may not be frozen.
  • All membership on a frozen status will be included in the annual CPI increase.

If a member has a different person as Payer of the Membership Agreement, the Payers contact details and signature must be obtained and completed on the Freezing Request Form, and will be verified by the Range / Club Administrator.

WAIVER AND RELEASE

In the act of becoming a member of Motion Fitness (referred to as “the Company”) I agree and acknowledge: that the Company will not be liable for death, injury, loss or damage suffered by me through or contributing to by any cause whatsoever, including but not limited to, any negligent (including gross negligent) act and/or omission or breach of contract on the part of the Company, its directors, shareholders, employees, contractors, independent consultants or other members(s); that the Company premises will invariably be entered and exited (inclusive of the parking area) entirely at my own risk and that the Company equipment and facility will, furthermore be utilised on this very same basis; that the Company would not be vicariously liable for any loss or damage suffered by me and/or other members(s) as a result of theft on the part of its employees, independent contractors, consultants or other members(s). In the process of becoming a member of Motion Fitness I and/or my estate, furthermore, indemnified the Company against any claim by any person arising directly or indirectly from my death, injury, loss or damage suffered by a member, allegedly caused or contributed to any act or omission by the Company, its directors, shareholders, employees, contractors, consultants, tenants or other member(s) and agents.

You acknowledge and agree that you have read your entire agreement; that you understand that the Motion Fitness Rules and Regulations are available on the Motion Fitness website www.motionfitness.co.za .

I understand that it is my responsibility to familiarise myself with the Rules and Regulations regularly and adhere to them at all times. Motion Fitness reserves the right to cancel this agreement if the information you supplied is found to be incorrect and/or false.
